Terms of Service

These terms are the agreement between you and Swell. By creating an account or using Swell, you agree to them. Please also read our Privacy Policy, which explains how we handle your information, including health-related information.
1. Who can use Swell
You must be at least 18 years old and legally able to enter into this agreement. You may hold only one account, and you must provide accurate information about yourself, including your date of birth.
We verify age from the date of birth you give us at sign-up. We do not independently verify identity, age, health conditions, professional credentials, or any other information members provide about themselves. If you misrepresent your age or eligibility, you are in breach of these terms, we may suspend or terminate your account without notice, and we are not responsible for any consequence of that misrepresentation - by you or by another member. Access to Swell by anyone under 18 is unauthorized, and nothing in these terms creates an obligation on our part to detect such access beyond the checks described here.
2. Swell is not medical advice
Swell is a peer community. Nothing shared on Swell - by members, in support groups, in the news section, or in the provider directory - is medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional about your condition. Provider listings and member reviews are informational and are not endorsements. If you are in crisis or experiencing a medical emergency, contact your local emergency services immediately.
Never delay seeking professional care, disregard advice from your clinician, or start, stop, or change any treatment because of something you read on Swell.
3. Member content is not ours, and we do not verify it
Posts, comments, group discussions, profiles, provider listings, and member reviews are created by members, not by Swell. We do not adopt, endorse, verify, or guarantee the accuracy, completeness, safety, or usefulness of member content, including anything describing a condition, symptom, treatment, medication, provider, or outcome. Views expressed by members are their own.
You rely on member content at your own risk, and Swell is not responsible or liable for it, for any decision you make based on it, or for the conduct of the member who posted it. Health experiences are individual: what helped one member may be ineffective or harmful for you.
We moderate content and remove violations when we find them, but moderation is not a guarantee of accuracy and does not make us the author or publisher of member content.
4. Your content
You own the content you post. By posting, you grant Swell a non-exclusive, worldwide, royalty-free license to host, store, and display that content for the purpose of operating the service. You are responsible for what you share - including any health information you choose to disclose about yourself.
Do not post information about another person's health or identity without their consent.
5. Community standards
The following are not allowed on Swell:
- Harassment, bullying, threats, hate speech, or discrimination.
- Sexual content involving minors, or any illegal content.
- Impersonating another person, provider, or organization.
- Spam, scams, pyramid schemes, or unsolicited commercial promotion.
- Dangerous health misinformation, or promoting products as treatments or cures.
- Encouraging self-harm, or sharing content that glorifies it.
- Scraping, reverse engineering, or automated access to the service.
We use a combination of automated content moderation and human review. Content that violates these standards may be blocked at the time of posting or removed later.
6. Reporting and blocking
Swell has zero tolerance for objectionable content or abusive behavior. Every profile, post, and comment can be reported. Reports go to a review queue monitored by our trust & safety team, and we aim to review every report and act within 24 hours - including removing content and suspending or terminating accounts. Separately, you can block any member at any time. A blocked member cannot message you, follow you, send you connection requests, or see your profile and posts, and you will not see theirs. You can manage blocked members from your profile settings.
7. Safety when meeting people
Swell helps you meet people for friendship, support, networking, and (in future) dating. We do not conduct criminal background checks on members. Use your judgment: meet in public places, tell someone where you are going, and never send money to someone you met online.
8. Accounts, suspension, and termination
You may delete your account at any time from your profile settings, which permanently removes your profile and personal data as described in our Privacy Policy. We may suspend or terminate accounts that violate these terms, put other members at risk, or are used unlawfully.
9. Paid features
Core community features are free. If we introduce paid features, pricing and renewal terms will be disclosed before purchase. Purchases made through the Apple App Store are governed by Apple's terms, and refunds are handled by Apple.
10. Service changes and availability
We are actively building Swell. Features may change, and we may add, modify, or remove functionality. We do not guarantee uninterrupted availability.
11. Disclaimer of warranties
Swell is provided "as is" and "as available", with all faults and without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.
We do not warrant that Swell will be uninterrupted, secure, error-free, or free of harmful components; that content on Swell is accurate, current, or reliable; that any member is who they claim to be, has the conditions or credentials they claim, or is of the age they claim; or that any connection, group, provider listing, or review will produce a particular result. No advice or information you obtain from Swell or its members creates any warranty.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by applicable law, Swell and its owners, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or relating to your use of Swell, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.
We are also not liable for: member content or conduct, online or offline, including anything a member tells you about your health; decisions you make based on content found on Swell; harm arising from meeting or communicating with another member; a member's misrepresentation of their age, identity, health, or credentials; unauthorized access to your account where you did not safeguard your credentials; or interruptions, data loss, or failures of third-party services we depend on.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to Swell is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you; in that case our liability is limited to the smallest amount permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Swell and its owners, officers, employees, contractors, and service providers from and against any claims, demands, disputes, damages, losses, liabilities, and costs (including reasonable legal fees) arising out of or related to: your use of Swell; your content, including any health information you post about yourself or anyone else; your breach of these terms or of any law; your misrepresentation of your age, identity, health, or professional credentials; your interactions with other members, online or offline; and any claim that your content infringed or harmed the rights of a third party.
We may assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you agree to cooperate with our defense. You will not settle any such matter without our prior written consent.
14. Resolving disputes
If you have a problem with Swell, please contact us first at support@swellsocial.life so we can try to resolve it informally. You agree to give us 30 days to respond before starting any formal proceeding. Most concerns are resolved at this stage.
Any claim that is not resolved informally must be brought individually. To the extent permitted by law, you and Swell each waive any right to bring or participate in a class action, collective action, or representative proceeding. Either of us may still bring an individual claim in small-claims court, and either of us may seek injunctive relief in court to protect intellectual property or account security.
You must bring any claim relating to Swell within one year after it arises, to the extent applicable law permits such a limit.
15. Governing law and jurisdiction
These terms and any dispute arising from them are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-laws rules. You and Swell agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute not subject to the individual-claim requirements above, and each of us consents to personal jurisdiction and venue there.
If you use Swell from outside the United States, you do so on your own initiative and are responsible for complying with local law. Nothing in this section removes any protection that the mandatory consumer law of your home country gives you.
16. If a term is unenforceable
If any part of these terms is found unenforceable, that part will be limited or removed to the minimum extent necessary and the rest of the terms will remain in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and Swell.
17. Changes to these terms
We may update these terms. If changes are material, we will notify you in the app or by email before they take effect. The "Last updated" date above always reflects the current version.
